1. Use of the Service

1.1 Eligibility

You must be at least 16 years old to use the Service.

1.2 Permitted Use

• Transcribe publicly accessible Reels for personal, educational, research, or commercial purposes
• Use AI analysis for content strategy
• Export and repurpose transcripts
• Integrate with the MCP server

1.3 Prohibited Use

• Infringe intellectual property rights
• Scrape or bulk-extract in violation of Instagram's Terms of Service
• Reverse engineer the Service
• Engage in illegal activity including harassment or defamation
• Attempt unauthorized access to systems
• Circumvent rate limits
• Use the Service to train competing AI models
• Misrepresent output generated by the Service

2. Accounts and Subscriptions

2.1 Free Tier

Unlimited base transcription with no account required for basics. Subject to fair use policies and may be modified.

2.2 Paid Plans

Starter, Pro, and Agency plans provide additional features as described on the pricing page. Billed monthly or annually in advance.

2.3 Billing and Cancellation

All fees are non-refundable except as required by law. You may cancel anytime from your dashboard — cancellation takes effect at the end of the current billing period. Pricing changes will be communicated with 30 days' notice.

2.4 Account Security

You are responsible for maintaining the security of your account credentials and all activity under your account. Notify support@lomero.app immediately if you suspect unauthorized access.

3. Content and Intellectual Property

3.1 Your Content

You retain full ownership of transcripts and analysis you generate. You grant Lomero a limited, non-exclusive license to process submitted URLs solely to provide the Service.

3.2 Third-Party Content (Instagram Reels)

Transcription generates a text representation of third-party content. You are responsible for compliance with copyright law and Instagram's Terms of Service. We strongly recommend obtaining permission before republishing, providing attribution, and using transcripts for analysis or research rather than verbatim republication.

3.3 Lomero's Intellectual Property

The Service — including its design, AI models, software, branding, and documentation — is owned by Lomero and protected by applicable intellectual property laws.

4. Third-Party Services and Integrations

Lomero integrates with Meta/Instagram, Anthropic/Claude, Stripe, and cloud infrastructure providers. We are not responsible for their availability, accuracy, or conduct.

5. Availability and Modifications

We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice, perform scheduled maintenance, and change the structure of the Service.

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind.

We do not warrant:

• 100% transcription accuracy
• Error-free AI results
• Uninterrupted availability
• That analyzed content does not infringe third-party rights

7. Limitation of Liability

To the maximum extent permitted by law, Lomero shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Total liability is limited to the greater of (A) the amount paid to Lomero in the 12 months prior to the claim, or (B) USD $50.

8. Indemnification

You agree to indemnify and hold harmless Lomero from claims arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.

9. Governing Law and Disputes

These Terms are governed by the laws of Thailand. Disputes shall be submitted to the competent courts of Bangkok, Thailand. EEA users may lodge complaints with their local data protection authority.

10. Changes to These Terms

Changes will be notified via the “Last Updated” date at the top of this page. For material changes, we will also notify you via email.
